There is video surveillance of them racing each other. There is no denying that. He admitted being next to them when the crash occurred.

I'm sure the state understood that drinking likely played a large part in the wreck. That and that there is no way to prove that Carter caused the wreck in and of himself when the staffer was impaired. So might as well settle for what they can prove.

But all of that doesn't mean his actions didn't contribute to how everything actually played out.

It doesnt mean it did. The claim they would not have been speeding if he was not there is a completely unprovable claim as is your saying the chances are 99%.
