Based off of his own testimony which admittedly could be wrong, I am going to side with the crowd that says he's around 40 right now.

I'm going to agree with this. That has been played up way too much. If true that is fine and that is a valid reason why he took a nose dive.

32 is still prime.

Faking 3 years younger is a whole another subject that is no better than taking performance enhancers. That is falsified information presented to a team offering a contract where age affects years Guaranteed.

That has no affect on the play of the game thus not the same. Come on now. Either admit you hate or stop this line.

No, just no. 32 is not prime. There is a massive body of data on this.

It affects the game. MLB just feels that injecting is a bigger infraction than fraud.

A concept of English law, a misrepresentation is an untrue or misleading[1] statement of fact made during negotiations by one party to another, the statement then inducing that other party into the contract.[2][3]The misled party may normally rescind the contract, and sometimes may be awarded damages as well (or instead of rescission).
The law of misrepresentation is an amalgam of contract and tort; and its sources are common law, equity and statute. The common law was amended by the Misrepresentation Act 1967. The general principle of misrepresentation has been adopted by the USA and various Commonwealth countries.[4]

This one was pure ID theft and MLB gave a hand slap.

Roberto Hernandez Heredia (a.k.a Fausto Carmona)
Heredia not only lied about his age when he was signed as a supposed teenage prospect out of the Dominican Republic by the Cleveland Indians — he lied about his name as well. In fact, he adopted a real person's identity, leading to his arrest on identity theft charges last year.

The fact is by US law MLB could break a contract with a player if said player lied pertaining age in the contract of note.

They don't because that would open a whole new issue. But the question is there verbage in the making of the contract or MLB contracts that supersede US law.

But by definition if a player lied on his birth certificate and turns 40. His perceived age is 36. At 33 his production nose dived and said team is paying 30 M AAV for replacement production well before his contract expires.

Over the next 2 years it comes to light that said player is in actuality 4 years over said age and the MLB team is on the hook for 4 years beyond their arranged contract.

By US law the player misrepresented pertaining information MLB. That could end up voiding the contract and said player could end up paying damages back to the team

The real question is has this happened and if not why.
